Domestic Violence in South Africa: Know Your Rights, Protection Orders & The Law

Domestic violence is not always visible. It isn’t limited to physical violence, and understanding what South African law recognises as domestic violence could be an important step towards protecting yourself or someone you care about.

In this episode of Legal Hour, we have an important conversation about domestic violence in South Africa, the legal protections available to victims, and why abuse continues to affect families and communities despite decades of legislation and awareness campaigns.

Joining us is Adv. Muhammad Abduraof, Advocate of the High Court of South Africa and Family Law Expert, as we explore what the law actually says, when someone should seek help, and how protection orders work.

We discuss the different forms domestic violence can take, including physical, emotional, psychological, sexual and economic abuse, intimidation, harassment, coercive and controlling behaviour, spiritual abuse, and the impact of exposing children to domestic violence.

The conversation also looks at the Domestic Violence Act and its strengthened protections, the relationship between domestic violence and constitutional rights such as equality, dignity and freedom and security of the person, and the challenges victims can face when trying to leave abusive situations.

Domestic violence is not simply a private family matter. It is a legal, social and human-rights issue. Abuse does not always leave a physical mark, and people should not have to wait until violence becomes severe before taking their experiences seriously.

If you or someone you know is experiencing domestic violence, understanding your legal rights and available protections can be an important first step.
